These terms apply to applicants and listed plumbing businesses. The Website Terms, Privacy Notice, Reviews Policy, Listing and Verification Policy, and Acceptable Use Policy also apply.
1. Eligibility and authority
You must be authorised to bind the business, be legally permitted to provide the advertised services, and supply accurate contact and trading details. You must notify us promptly of changes.
2. Evidence and profile claims
On request, provide current evidence of identity, business status, relevant qualifications/registrations, insurance and memberships. You authorise proportionate checks with issuers and public registers. A badge applies only to the check described in the Listing and Verification Policy and only for the recorded period. You must not imply our checks guarantee your work.
3. Enquiries and customer data
Use enquiry data only to respond to the relevant request, arrange or provide the requested service, maintain necessary records and meet legal obligations. Do not resell it, add it to unrelated marketing lists or disclose it unnecessarily. Protect access, delete data when no longer needed, honour data rights and notify us promptly of a relevant security incident. Each party acts as an independent controller for its own processing unless a written agreement states otherwise.
4. Customer contracts and conduct
You contract directly with customers and are solely responsible for quotations, availability, appointments, workmanship, staff/subcontractors, safety, taxes, payment, cancellations, guarantees, complaints and legal compliance. Provide clear pre-contract information and fair terms. Do not misrepresent urgency, price, accreditation or need for work.
5. Reviews
Do not write or commission fake reviews, review your own business, incentivise only positive reviews, pressure reviewers, suppress criticism or retaliate. You may provide a professional response and evidence under the Reviews Policy. We control moderation independently and do not promise removal of an unfavourable review.
6. Content licence
You retain ownership of authorised profile content and grant us a non-exclusive, worldwide, royalty-free licence to store, adapt for layout, publish and promote it in connection with the directory. You warrant that content is accurate, lawful and does not infringe rights. Do not upload customer images or personal data without authority.
7. Ranking, fees and leads
No listing guarantees rank, traffic, leads, exclusivity, conversion or revenue. Any paid feature, lead fee or subscription must be set out in a separate order with price, term, cancellation and renewal information. Sponsored placement will be labelled and must not secretly determine organic review treatment.
8. Portal security
Keep credentials confidential, use strong passwords and notify us of suspected compromise. You are responsible for authorised account activity. Proposed profile edits may remain unpublished until reviewed.
9. Suspension and removal
We may request evidence, correct content, pause badges, restrict leads, suspend or remove a profile where information is doubtful, evidence expires, complaints raise a material risk, rules are breached, payment is due, or action is reasonably needed for users or legal compliance. Where appropriate we will explain the reason and offer a review route, but urgent interim action may be immediate.
10. Liability and indemnity
Nothing excludes liability that cannot legally be excluded. Subject to that, neither party is liable for indirect or consequential loss, or loss of profit, business or opportunity not reasonably foreseeable from its breach. Our aggregate liability arising from a paid business service in a 12-month period will not exceed the fees paid for that service in that period; for a free listing, the cap is £100. This cap must be reviewed by a UK solicitor before use. You will reimburse reasonable losses and costs caused by your unlawful content, misuse of customer data or breach of your warranties, except to the extent caused by us.
11. Term and general terms
Either party may end a free listing on notice, subject to necessary records and unresolved matters. Material changes will be notified before taking effect where practicable. These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction for business disputes. Contact info@nottinghamplumbers.uk.
